§ 12-3. Picketing.

  • (a)

    Location.

    (1)

    Picketing and demonstrations shall be conducted only on the public sidewalks maintained by the city, except that picketing and demonstrations may take place on the grassy area of Market Street, no more than six (6) feet from the curb.

    (2)

    Picketing and demonstrations shall be conducted in a manner that does not hamper, obstruct, impede, or otherwise interfere with pedestrian or motor vehicle traffic.

    (3)

    Picketing and demonstrations shall not be conducted in front of or be focused on any particular residence.

    (4)

    Picketing and demonstrations shall be conducted in a way that does not block entrances to any building, area, or other structure.

    (5)

    Picketing and demonstrations shall not hamper, obstruct, impede, or otherwise interfere with the ability to enter or exit a building, area, or any other structure.

    (b)

    Notice.

    (1)

    The chief of police shall receive at least five (5) hours of notice in writing by the person planning to picket or demonstrate.

    (2)

    This written notice shall include the name of the person planning to picket or demonstrate, and where applicable, the name of the organization planning to picket, and shall also include the name of the places or business, public facility or other location or entity which will be picketed and the hours that the picketing or demonstration will be conducted.

    (3)

    At the request of the chief of police, the person planning to picket or demonstrate may be required to provide the city with an agreement to indemnify and save the city harmless for any damages, demands, or expenses of every character which may be in any way caused by the picketing or demonstration.

    (c)

    Other.

    (1)

    No person participating in picketing or demonstrations shall create any loud, disturbing, and unnecessary noise, including any noise that is in violation of section 10-20 of this Code.

    (2)

    No person participating in picketing or a demonstration shall use a bullhorn, microphone, loudspeaker, or any other means of magnifying one's voice.

    (3)

    No person shall unreasonably hamper, obstruct, impede, or otherwise interfere with any picketing or demonstration.

    (4)

    If at any time picketing or a demonstration in any way obstructs, impedes, or otherwise interferes with any type of motor vehicle or pedestrian traffic, including traffic moving in and out of a building, participants shall disperse or move along as directed by a police officer.

    It shall be unlawful to refuse to disperse or move along if so directed by a police officer.

    (5)

    Picketers and demonstrators shall not act in a way that violates any provision of this chapter or any other part of this Code, or the laws of this state.
