§ 2.5-12. Application contents.

  • Each application for an adult entertainment establishment occupation tax certificate shall contain the following information:

    (1)

    The applicant's full true name.

    (2)

    The present address and telephone number of the applicant.

    (3)

    Acceptable written proof that the applicant is at least eighteen (18) years of age.

    (4)

    Business, occupation or employment history of the applicant for the five (5) years immediately preceding the date of application to include business or employment records of the applicant, all partners if a partnership or association, and all officers and directors if a corporation.

    (5)

    The business license or occupation tax history of the applicant and whether such applicant, in previous operations in this or any other city, or state had any license or occupation tax certificate for an adult entertainment establishment or similar type of business suspended or revoked, the reason therefore, and the business activity or occupation engaged in following suspension or revocation of the license.

    (6)

    If the applicant is a corporation, the name of the corporation shall be set forth exactly as shown in its articles of incorporation or charter, together with the place and date of incorporation, the names and address of each of its current officers and directors. An association shall provide the names and addresses of all its members. A partnership shall provide the names and addresses of all its partners. If the applicant is a limited partnership, it shall furnish a copy of its certificate of limited partnership filed with the county clerk along with the names and addresses of its general and limited partners. If one (1) or more of the partners is a corporation, the provisions of this subsection dealing with corporations shall also be applied. The applicant corporation or partnership shall designate one (1) of its officers or general partners to act as its responsible managing official. Such designated person shall complete and sign all application forms required of any individual applicant under this chapter, but only one (1) application fee shall be charged.

    (7)

    If the applicant, any partners or any corporate officers or directors, have been convicted of any crime in the last five (5) years such that they would not be considered of good moral character as defined in this chapter, a complete description of such crime including date of violation, date of conviction, jurisdiction and any disposition, including any fine or sentence imposed shall be provided as well as a statement of the current disposition of the case.

    (8)

    If the applicant is doing business under a trade name, a copy of the trade name registration shall be provided. All foreign corporations shall provide a certificate from the Secretary of State that they are qualified to do business in the State of Georgia. All corporations shall provide the current name and address of their designated agent for service of process and a copy of their most recent operating statement.

    (9)

    At least three (3) character references from individuals who are in no way related by blood or marriage to the applicant, any partner or shareholder, officer or director and who are not or will not benefit financially from the operation of the adult entertainment establishment seeking a license.

    (10)

    Address of the premises to be regulated.

    (11)

    Whether the premises are leased or owned.

    (12)

    A plat by a registered land surveyor in the State of Georgia, showing the location of the premises to be regulated and showing that it is in compliance with the zoning and distance requirements set forth in section 2.5-9 of this chapter.

    (13)

    Each applicant for an adult entertainment establishment occupation tax certificate shall be verified and acknowledged under oath to be true and correct by:

    a.

    If the applicant is an individual, the individual;

    b.

    If by a partnership, by the manager or general partner;

    c.

    If a corporation by the president of the corporation;

    d.

    If any other organization or association, by the chief administrative official.

    (14)

    Any applicant seeking a license for an adult dancing establishment or an erotic dance establishment shall provide architectural drawings certified as correct by an architect licensed in and by the State of Georgia which clearly shows the size, location and elevation of all platforms and stages required under section 2.5-3(j) of this Code and which shows the location and form of barrier described under section 2.3-3(k) of this Code.
