§ 2.5-9. Location.

  • No adult entertainment establishment regulated hereunder shall be located:

    (1)

    Within two hundred fifty (250) feet of any parcel of land which is zoned for multifamily or single family uses or purposes which would include zoning classification R1, RM, and ROI as defined in Article XIII of Appendix A of the Code of Ordinances of Clarkston, Georgia.

    (2)

    Within two hundred fifty (250) feet of any parcel of land upon which a church, library, school, daycare center, kindergarten or public park is located.

    (3)

    Within one thousand (1,000) feet of any parcel of land upon which another adult entertainment establishment regulated hereunder is located.

    (4)

    Within any zoning category other than the following categories:

    a.

    MI Light Industry district as defined in Sec. 1307 of Appendix A of the Code of Ordinances of Clarkston, Georgia.

    b.

    C1, C2, and C3 Business districts as defined in Sections 1303, 1304 and 1305 of Appendix A of the Code of Ordinances of Clarkston, Georgia.

    For the purposes of this section, distance shall be measured along a straight line from property line to property line using the closest property lines of the parcels of land involved. The term parcel of land means any quantity of land capable of being described by location and boundary, designated and used or to be used as a unit so long as the same is a parcel which is of sufficient size and shape to be used as a lot in the city.
