Article II. OFFENSES AGAINST PUBLIC PEACE AND ORDER |
§ 12-21. Public indecency.
(a)
Prohibited conduct. A person commits the act of public indecency when he or she performs any of the following acts in a public place:
(1)
An exposure of the sexual organs;
(2)
An appearance in a state of partial or complete nudity; or
(3)
An act of sexual intercourse; or
(4)
Urinates or defecates in a public place other than a bathroom facility; or
(5)
A caress or indecent fondling of the body of another person.
(b)
Exceptions. The prohibited conduct set forth in subsections 12-21(a)(1) and (2) of this chapter shall not apply to the following persons:
(1)
Any child under the age of ten (10); or
(2)
Any female person exposing a breast while breastfeeding an infant under two (2) years old.
