§ 2.5-21. Appeal-alternative procedures.

  • When an appeal is placed on the council agenda, the council may take either of the following actions:

    (1)

    Set a hearing date no more than ten (10) days following the council meeting and instruct the city clerk to give such notice of hearing as may be required by law.

    (2)

    Appoint a hearing officer and fix the time and place for hearing to be no later than ten (10) days following the council meeting. The hearing officer shall be an attorney-at-law licensed to practice in the State of Georgia for no less than three (3) years, may not be a city employee, and may be appointed for an extended period of time. The clerk shall assume responsibility for such publication of notice of the hearing as may be required by law. If a hearing officer is appointed, the hearing shall be conducted in accordance with the procedures set out in this chapter.
