§ 14-5. Merit system.

  • Hiring, firing, and other terms of employment with the City of Clarkston shall be governed exclusively by merit. Employees of the city that have successfully completed a probationary period may only be subjected to a substantial adverse employment action, such as demotion or termination, for cause. However, the city manager shall also have the authority to make necessary lay-offs or reductions in work hours when a lack of work or budget constraints necessitate such action. The city manager shall promulgate rules for employee discipline and an appeal procedure that includes due process for non-probationary employees. An employee that is dissatisfied with an appeal pursuant to the procedure established by the city manager shall have certiorari to the Superior Court of DeKalb County as his exclusive remedy.
